Ethical and legal traditions recognize prenatal duties to avoid harm to offspring. However, applying the harm principle to pregnancy requires a careful balancing of a baby's welfare with a pregnant woman's interest in liberty and bodily integrity. In the case of maternal PKU the mother can prevent harm to her baby by returning to the admittedly unpleasant diet that prevented her from being retarded. Informing, counseling, and access to medical care should be the primary policy. Seizures and forced treatment cannot (...) be justified in this case, and only rarely in other situations. (shrink)

It is argued that John Rawls’ theory of social justice as well as the contract argument for it are misleading, if not actually mistaken, in that they appear to take institutional features of societies as fundamental objects of moral evaluation. An alternative view: is expounded. Principles involving institutional features are only contingently related to principles involving the distribution of things people care about. These distributions are taken as the fundamental objects of moral evaluation. Social, political and economic institutions are (...) means to achieve more desirable distributions. Wolfgang Stegmüller, the leading German philosopher of science, considers the status of scientific revolutions the central issue in the field ever since "the famous Popper-Lakatos-Kuhn discussion" of a decade and a half ago, comments on "almost all contributions to this problem", and offers his alternative solutions in a series of papers culminating with, and summarized in, his recent "A Combined Approach to Dynamics of Theories. How To Improve Historical Interpretations of Theory Change By Applying Set Theoretical Structures", published in Gerard (...) Radnitzky and Gunnar Andersson, editors, The Structure and Development of Science, issued in the Boston Studies in the Philosophy of Science series, volume 59, 1979, pp. 151-86. Popper views scientific revolutions as rational and due to empirical refutations, but there are no refutations in science. Lakatos agrees and assumes that research programs are refutable and their replacements to be revolutions, but the same arguments he launches against Popper apply to him; moreover, applying his philosophy to itself makes it collapse anyway . Kuhn's view was interpreted to be one of scientific revolutions as quite irrational and as arbitrary as mob action. Stegmüller presents revolution in another interpretation of Kuhn - as non-rational, as based on hopes and value judgment but not on facts. He thinks there are big and small revolutions. And he uses his own modifications of J. D. Sneed's famous formal analysis of scientific theory to make his point. After presenting a summary of Stegmüller's ideas in our own way, which seems to us a clarification of presentation with no change of content, especially due to our stressing all differences of opinion, we apply Stegmüller's idea to itself, the way Stegmüller has done with the view of Lakatos, and with similar results. The twentieth century enjoys a firm grip on our profession. Well over half the research articles published in this journal since 2000 devote significant attention to the period between the 1890s and the 1990s. Similar trends prevail in other leading publications. But this outpouring of scholarship alone does not create a collective sense of how historians of science should confront the twentieth century as an epoch. The synthetic reflection that established the scientific revolution as a historiographical category and lent the (...) nineteenth century a sense of cohesion remains to be undertaken for the twentieth. A panoramic outlook on more recent historical eras is a pressing necessity. Publishing trends suggest that we will confront future methodological questions and navigate our evolving professional identity largely on twentieth-century turf. What, then, defines twentieth-century science? In some ways, this question is naive, even trivial: it surprises no one that the currents of history disdain our thin calendrical embankments. But centuries, decades, and other conventional durations often prove useful for collating practices that shared a family resemblance and naming periods about which we might claim that continuity prevailed over discontinuity. Can the twentieth century offer such utility? The books under review can each be read as an attempt to use the twentieth century in that way and, in so doing, to claim it for a particular vision of how the history of science should be done. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. Recent EEG studies on the early postmortem interval that suggest the persistence of electrophysiological coherence and connectivity in the brain of animals and humans reinforce the need for further investigation of the relationship between the brain’s activity and the dying process. Neuroscience is now in a position to empirically evaluate the extended process of dying and, more specifically, to investigate the possibility of brain activity following the cessation of cardiac and respiratory function. Under the direction of the Center for Healthy (...) Minds at the University of Wisconsin-Madison, research was conducted in India on a postmortem meditative state cultivated by some Tibetan Buddhist practitioners in which decomposition is putatively delayed. For all healthy baseline and postmortem subjects presented here, we collected resting state electroencephalographic data, mismatch negativity, and auditory brainstem response. In this study, we present HB data to demonstrate the feasibility of a sparse electrode EEG configuration to capture well-defined ERP waveforms from living subjects under very challenging field conditions. While living subjects displayed well-defined MMN and ABR responses, no recognizable EEG waveforms were discernable in any of the tukdam cases. (shrink)

The issue of the institution is not addressed systematically anywhere in the literature on Foucault, although it is everywhere to be found in Foucault's writings._ Foucault and the Critique of Institutions_ not only interprets the work of Foucault but also applies it to the question of the institution. Foucault is a master at analyzing the web of social relations that effectively shape the modern individual. While these social relations are smaller and finer than institutions, institutions are, by Foucault's account, saturated (...) with such relations. This study is the first sustained account to follow up the implications of Foucault's provocative theses about power for the analysis of institutions. _Foucault and the Critique of Institutions _offers a set of preliminary essays that raise basic questions about the theoretical character of Foucault's thought and then several groups of other essays that go on to take up the practical issues raised by his work. Joseph Margolis and Jitendra Mohanty address one of the most complex problems posed by Foucault's texts: his status as a philosopher. Mark Poster explores the problem of the "self" in Foucault, while Judith Butler focuses her searching investigation of the self on its gendered nature. Joseph Rouse examines the functioning of the natural sciences within the institutional setting of the university and the academic profession, while Chuck Dyke and Mary Schmelzer present vigorous critiques of the normalizing power of the university. This paper explores the essays of two prominent ecclesiologists, Joseph Komonchak and Hans Urs Von Balthasar, on their respective fundamental definitions of the Church. Gleaning insights from their different perspectives, the paper applies aspects of Lonergan's philosophy in order to clarify some methodological presuppositions and some ecclesial distortions to be corrected in light of those presuppositions. Additionally, it addresses two fundamental issues for consideration in a post-conciliar theology of the Church.

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. IntroductionAccording to Anselm of Canterbury, God gave human beings two affectiones: the affectio commodi and the affectio iustitiae. For Anselm, these two affectiones are largely equivalent to egoistic motivation and non-egoistic (specifically, moral) motivation: the affectio commodi motivates one to seek one's own advantage (commodum), while the affectio iustitiae motivates one (...) to seek justice (iustitia) for its own sake. Two centuries after Anselm, John Duns Scotus appropriated the terms affectio commodi and affectio iustitiae but made some changes to Anselm's account of the affectiones. Anselm thinks that human beings lost the affectio iustitiae when Adam sinned1 and can regain it only through divine grace,2 but Scotus regards the affectio iustitiae as innate to human beings.3 Also, [End Page 53] Scotus integrates his account of the affectio commodi into the Aristotelian natural teleology commonly accepted at his time, associating the affectio commodi with one's inclination toward one's natural end.4Although Scotus modifies Anselm's account of the affectiones, many interpreters think that he preserves the affectio commodi's association with egoism and the affectio iustitiae's association with non-egoism. I call this interpretation of Scotus's two affectiones "the Standard Reading." On the Standard Reading, the affectio commodi is one's inclination to will things for one's own benefit.5 The Standard Reading's proponents disagree about what exactly the affectio iustitiae is. In this paper I consider one of the influential challenges to the notion that perceptual experience might be completely conceptually structured, a challenge that rests on the idea that conceptual structure cannot do justice to the fineness of grain of perceptual experience. In so doing, I canvass John McDowell's attempt to meet this challenge by appeal to the notion of demonstrative concepts and review some criticisms recently leveled at McDowell's deployment of demonstrative concepts for this purpose by Sean D. (...) Kelly. Finally, I suggest that, though Kelly's criticisms might challenge McDowell's original presentation of demonstrative concepts, a modified notion of demonstrative concepts is available to the conceptualist that is proof against Kelly's criticisms. IN THE winter and spring of 1031,1 was invited to give a series of ten lectures at Harvard University. The subject chosen was the Philosophy of Art; the lectures are the origin of the present volume. The Lectureship was founded in memory of William James and I esteem it a great honor to have this book associated even indirectly with his distinguished name. But in commencing this discussion, I’d like to propose a route, which traces your professional journey to this point in your career, and how it led you on your search to reveal consciousness in those patients who lack expressive capability. You went into palliative care first, and that brought you to where you are today. [End Page 227]Prof. Joseph J. FINS:First, let me thank you and the Pellegrino Center for the honor of giving the John Harvey Collins Lecture in such an interactive manner. The forefront of neurological care—and the neuroethical issues and methods focal to such practice—wasn’t what I initially intended to do professionally, but I think that therein is a good lesson for young people’s career aspirations. Simply put, one doesn’t always know where they’ll end up at the beginning of the journey, and as Kierkegaard said, life is lived forward, but is understood backwards (Kierkegaard 1843).In the nineties and the early 2000s, I was trying to help improve the quality of care of people at the end of life, and I wrote a book, entitled The Palliative Ethic of Care: Clinical Wisdom at Life’s End (Fins 2006), in which I addressed notions of phronesis—practical wisdom—in integrating theory and practice toward improving how people die. I became interested in the Quinlan case (Quinlan 1976), and the right to die, and around the same time, I ran into a colleague of mine at Cornell: Dr. Nicholas D. Schiff. Dr. Schiff is a neurologist, who was a protégé of Fred Plum, who was the originator of the concept of the vegetative state with Bryan Jennett, back in 1972. Fred was both of our teachers here at Cornell. Niko (Dr. Schiff) was interested in patients with disorders of consciousness, and was beginning to envision doing work—that ultimately, we did—using deep brain stimulation (DBS) to try to treat patients in the minimally conscious state, a category that was subsequently codified in 2002.I realized that a whole population of people—with these disorders of consciousness—had been somewhat marginalized, and their neglect essentially devolves back to the considerations of the right to die. The right to die was established in the Quinlan case because Judge Hughes—the presiding chief judge of the New Jersey Supreme Court—talked about Ms. Quinlan’s loss of a cognitive, sapient state as being the moral warrant for her right to die, given the fact that it was viewed as a futile situation. I recognized, over the ensuing years—from my background in palliative and end-of-life care—[1] that we had over-generalized notions of futility... (shrink)
